Somut olayda, mirasb\u0131rakan &#8230; 02.06.2011 tarihinde vefat etmi\u015f, en yak\u0131n yasal miras\u00e7\u0131lar\u0131n tamam\u0131 taraf\u0131ndan miras reddolunmu\u015ftur. Sosyal G\u00fcvenlik Kurumu Ba\u015fkanl\u0131\u011f\u0131n\u0131n 09.07.2013 tarihli yaz\u0131s\u0131nda belirtildi\u011fi \u00fczere, &#8230;\u2019e kamu emeklisi olmas\u0131 nedeniyle 04.06.2009 tarihinde \u2026TL emekli ikramiyesi tahakkuk ettirilmi\u015ftir. Mahkemece, emekli ikramiyesinin Kanun gere\u011fi hak sahibi miras\u00e7\u0131lara ait olmas\u0131na kar\u015f\u0131n tereke kapsam\u0131na dahil edilerek tasfiyeye tabi tutulmu\u015f olmas\u0131 do\u011fru g\u00f6r\u00fclmemi\u015f ve h\u00fckm\u00fcn bu nedenlerle bozulmas\u0131 gerekmi\u015ftir.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-93aab45 elementor-widget elementor-widget-text-editor\" data-id=\"93aab45\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>(4721 S. Hukuk Dairesinin bozma ilam\u0131na uyularak yap\u0131lan yarg\u0131lama sonucunda iflas\u0131n kapanmas\u0131na dair verilen 23\/06\/2017 g\u00fcnl\u00fc h\u00fckm\u00fcn Yarg\u0131tayca incelenmesi miras\u00e7\u0131lar vekili taraf\u0131ndan istenilmekle s\u00fcresinde oldu\u011fu anla\u015f\u0131lan temyiz dilek\u00e7esinin kabul\u00fcne karar verildikten sonra dosya ve i\u00e7erisindeki b\u00fct\u00fcn ka\u011f\u0131tlar incelenerek gere\u011fi d\u00fc\u015f\u00fcn\u00fcld\u00fc:<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ccfac0e elementor-widget elementor-widget-text-editor\" data-id=\"ccfac0e\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Karar: Talep, en yak\u0131n yasal miras\u00e7\u0131lar\u0131n\u0131n tamam\u0131 taraf\u0131ndan miras\u0131 reddedilen mirasb\u0131rakan\u0131n terekesinin iflas h\u00fck\u00fcmlerine g\u00f6re tasfiyesine ili\u015fkindir.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-81b59c2 elementor-widget elementor-widget-text-editor\" data-id=\"81b59c2\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Davac\u0131 vekili; m\u00fcvekkiline bor\u00e7lu olan mirasb\u0131rakan &#8230;\u2019in miras\u0131n\u0131n en yak\u0131n yasal miras\u00e7\u0131lar\u0131n\u0131n tamam\u0131 taraf\u0131ndan Zonguldak 2. Asliye Hukuk Mahkemesinin 2011\/346 Esas, 2012\/231 Karar say\u0131l\u0131 ilam\u0131yla reddedildi\u011fini, m\u00fcvekkilinin &#8230;\u2019e kar\u015f\u0131 icra takibine itiraz\u0131n iptali i\u00e7in a\u00e7t\u0131\u011f\u0131 Ankara 4. Ticaret Mahkemesinin 2008\/450 Esas say\u0131l\u0131 dosyas\u0131nda ald\u0131\u011f\u0131 yetkiye istinaden mirasb\u0131rakan &#8230;&#8217;in terekesinin iflas h\u00fck\u00fcmlerine g\u00f6re tasfiyesini istemi\u015ftir.<\/p><p>\u00a0<\/p><p>Miras\u00e7\u0131lar vekili, davac\u0131n\u0131n alaca\u011f\u0131n\u0131 takip etti\u011fi icra dosyas\u0131nda haciz konulan murisin emekli ikramiyesi ve maa\u015f\u0131n\u0131n terekeye dahil olmad\u0131\u011f\u0131n\u0131 belirterek, miras\u00e7\u0131lara ait oldu\u011funun tespitini ve terekenin bu \u015fekilde tasfiyesini savunmu\u015ftur.<\/p><p>\u00a0<\/p><p>Terekenin iflas h\u00fck\u00fcmlerine g\u00f6re tasfiyesine ili\u015fkin verilen karar, miras\u00e7\u0131lar vekilinin temyizi \u00fczerine Yarg\u0131tay 8. Hukuk Dairesince 2014\/346 Esas, 2014\/21586 Karar say\u0131l\u0131 ilam\u0131 ile bozulmu\u015ftur.<\/p><p>\u00a0<\/p><p>Mahkemece bozma ilam\u0131na uyularak iflas\u0131n kapanmas\u0131na karar verilmi\u015ftir.<\/p><p>\u00a0<\/p><p>H\u00fckm\u00fc, miras\u00e7\u0131lar vekili emekli ikramiyesi ve maa\u015f\u0131n\u0131n terekeye dahil olmad\u0131\u011f\u0131n\u0131 belirterek temyiz etmi\u015ftir.<\/p><p>\u00a0<\/p><p>\u00d6lenin en yak\u0131n yasal miras\u00e7\u0131lar\u0131n\u0131n tamam\u0131 taraf\u0131ndan reddolunan miras, sulh mahkemesince iflas h\u00fck\u00fcmlerine g\u00f6re tasfiye edilir. Tasfiye sonunda arta kalan de\u011ferler, miras\u0131 reddetmemi\u015fler gibi hak sahiplerine verilir. (TMK. m.612\/1-2) \u0130\u0130K&#8217;nun 180. maddesi; reddolunan miras\u0131n tasfiyesinin sekizinci bap (md.208-256) h\u00fck\u00fcmlerine g\u00f6re; ait oldu\u011fu mahkemece yap\u0131laca\u011f\u0131n\u0131 h\u00fckme ba\u011flam\u0131\u015ft\u0131r. \u00d6yleyse, mahkemece iflas masas\u0131 te\u015fkil edilip (md.208), iflas dairesi olu\u015fturulmas\u0131, iflas dairesince tasfiyenin adi veya basit \u015fekilde yap\u0131lmas\u0131na karar verildikten (md.208\/3) sonra se\u00e7ilecek tasfiye y\u00f6ntemine g\u00f6re gerekli i\u015flemlerin yap\u0131lmas\u0131n\u0131n izlenmesi, terekeye (masaya) dahil hi\u00e7bir malvarl\u0131\u011f\u0131 bulunmaz ise, iflas dairesince tasfiyenin tatiline karar verilip, bu hususun ilan edilmesi (md.217), bu ilanda tereke alacakl\u0131lar\u0131 taraf\u0131ndan otuz g\u00fcn i\u00e7inde iflasa m\u00fcteallik muamelelerin tatbikine devam edilmesinin istenmemesi halinde iflas\u0131n kapat\u0131laca\u011f\u0131n\u0131n a\u00e7\u0131k\u00e7a yaz\u0131lmas\u0131 (md.217); en son olarak da y\u00fcr\u00fct\u00fclecek i\u015flemlerin sonucuna g\u00f6re iflas\u0131n kapanmas\u0131na (md.254) karar verilebilece\u011fi g\u00f6z\u00f6n\u00fcne al\u0131nmaks\u0131z\u0131n sadece y\u00fcr\u00fct\u00fclecek i\u015flemlerin neler oldu\u011funa i\u015faret edilmek suretiyle dosyan\u0131n kapat\u0131lmas\u0131na karar verilmesi usul ve yasaya ayk\u0131r\u0131 olmu\u015ftur.<\/p><p>\u00a0<\/p><p>5434 say\u0131l\u0131 T\u00fcrkiye Cumhuriyeti Emekli Sand\u0131\u011f\u0131 Kanununun 89\/10. maddesinde, Sosyal G\u00fcvenlik Kurumunca tahakkuk ettirilmi\u015f veya ettirilecek emekli ikramiyelerini almadan \u00f6lenler ile \u00f6l\u00fcm tarihinde ayl\u0131\u011fa m\u00fcstahak dul ve yetim b\u0131rakmadan \u00f6len i\u015ftirak\u00e7ilerin ikramiyelerinin kanuni miras\u00e7\u0131lar\u0131na \u00f6denece\u011fi d\u00fczenlenmi\u015ftir.<\/p><p>\u00a0<\/p><p>Yarg\u0131tay 14. Hukuk Dairesinin 2015\/17979 Esas, 2016\/7416 Karar ve 22.09.2016 tarihli karar\u0131nda, mirasb\u0131rakan\u0131n \u00f6l\u00fcm\u00fc nedeniyle davac\u0131lara \u00f6denen ikramiyenin, hak sahiplerinin s\u0131fat\u0131ndan do\u011fan haklardan oldu\u011fu ve terekeye dahil olmad\u0131\u011f\u0131, emekli ikramiyesini alman\u0131n terekenin sahiplenilmesi anlam\u0131na gelemeyece\u011fi belirtilmi\u015ftir.<\/p><p>\u00a0<\/p><p>Yarg\u0131tay 8. Hukuk Dairesinin 2019\/2083 Esas, 2020\/6248 Karar ve 15.10.2020 tarihli karar\u0131nda, emekli ikramiyesinin tamam\u0131n\u0131n dul ve yetim ayl\u0131\u011f\u0131na hak kazanan ki\u015filere \u00f6denece\u011fi Sosyal G\u00fcvenlik Yasas\u0131\u2019nda h\u00fck\u00fcm alt\u0131na al\u0131nd\u0131\u011f\u0131ndan, terekeye dahil edilmeyip hak sahiplerine ait olaca\u011f\u0131 belirtilmi\u015ftir.<\/p><p>\u00a0<\/p><p>Emekli Sand\u0131\u011f\u0131nca yap\u0131lan toptan \u00f6deme, miras\u00e7\u0131lara ait oldu\u011fu i\u00e7in terekeye eklenmez, Kanun gere\u011fi miras\u00e7\u0131lara verilen bir para oldu\u011fu i\u00e7in tenkis davas\u0131na konu te\u015fkil etmez. Hukuk Dairesinin 27.02.1967 g\u00fcnl\u00fc 953\/1097 say\u0131l\u0131 karar\u0131)<\/p><p>\u00a0<\/p><p>Somut olayda, mirasb\u0131rakan &#8230; \u00a002.06.2011 tarihinde vefat etmi\u015f, en yak\u0131n yasal miras\u00e7\u0131lar\u0131n tamam\u0131 taraf\u0131ndan miras reddolunmu\u015ftur. Sosyal G\u00fcvenlik Kurumu Ba\u015fkanl\u0131\u011f\u0131n\u0131n 09.07.2013 tarihli yaz\u0131s\u0131nda belirtildi\u011fi \u00fczere, &#8230;\u2019e kamu emeklisi olmas\u0131 nedeniyle 04.06.2009 tarihinde 40.025,87TL emekli ikramiyesi tahakkuk ettirilmi\u015ftir.
