elementor-size-default\">Qu'est-ce qu'une action en annulation de la copropri\u00e9t\u00e9 ?<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f987b1d elementor-widget elementor-widget-text-editor\" data-id=\"f987b1d\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>L'action en annulation de la copropri\u00e9t\u00e9, ou action en partage, est un type d'action bilat\u00e9rale visant \u00e0 mettre fin \u00e0 la relation de copropri\u00e9t\u00e9 existante entre les parties\/les copropri\u00e9taires sur des biens immobiliers ou mobiliers, qu'ils soient en indivision (copropri\u00e9t\u00e9) ou en pleine propri\u00e9t\u00e9 (propri\u00e9t\u00e9 en commun). Cette action permet de mettre fin \u00e0 la copropri\u00e9t\u00e9 et de passer \u00e0 la propri\u00e9t\u00e9 individuelle.<\/p><p>\u00a0 Les copropri\u00e9taires peuvent demander, par le biais de l'action en annulation de la copropri\u00e9t\u00e9 :<\/p><ul><li><span style=\"font-weight: normal;\">\u00a0 \u00a0 \u00a0 \u00a0 La dissolution de la copropri\u00e9t\u00e9 par la vente des biens,<\/span><\/li><\/ul><ul><li><span style=\"font-weight: normal;\">\u00a0 \u00a0 \u00a0 \u00a0 La dissolution de la copropri\u00e9t\u00e9 par la constitution d'une copropri\u00e9t\u00e9 en tant que telle,<\/span><\/li><\/ul><ul><li><span style=\"font-weight: normal;\">\u00a0 \u00a0 \u00a0 \u00a0 La dissolution de la copropri\u00e9t\u00e9 par le partage en nature des biens.<\/span><\/li><\/ul><p>\u00a0<\/p><p class=\" translation-block\">Les copropri\u00e9taires peuvent convenir, par un accord, de ne pas demander l'annulation de la copropri\u00e9t\u00e9. Cela repose sur le principe selon lequel personne ne peut \u00eatre contraint \u00e0 la continuation de la situation de propri\u00e9t\u00e9 partag\u00e9e.<\/p><p class=\" translation-block\">Selon le premier paragraphe de l'article 698 du Code Civil turc : \u00ab \u00c0 moins qu'une obligation de maintenir la propri\u00e9t\u00e9 partag\u00e9e ne soit impos\u00e9e en vertu d'un acte juridique ou en raison de l'affectation permanente du bien \u00e0 un objectif particulier, chaque coparticipant peut demander le partage du bien. \u00bb<\/p><p>Conform\u00e9ment \u00e0 l'article susmentionn\u00e9, le droit d'intenter une action en liquidation de l'indivision appartient aux co-indivisaires. Autrement dit, chacun des associ\u00e9s peut demander le partage du bien. Les actions en liquidation de l'indivision peuvent \u00eatre intent\u00e9es soit s\u00e9par\u00e9ment par chaque associ\u00e9, soit par plusieurs associ\u00e9s contre d'autres associ\u00e9s. Conform\u00e9ment aux r\u00e8gles de comp\u00e9tence g\u00e9n\u00e9rale, le tribunal comp\u00e9tent pour l'action en annulation de la copropri\u00e9t\u00e9 est celui du domicile du d\u00e9fendeur \u00e0 la date de l'ouverture de l'action (article 6 du Code de proc\u00e9dure civile). Si l'objet de la copropri\u00e9t\u00e9 est un bien immobilier, le tribunal comp\u00e9tent est le tribunal de paix du lieu o\u00f9 se trouve le bien immobilier concern\u00e9 (article 12 du Code de proc\u00e9dure civile).<\/p><p>\u00c0 ce stade, il convient de souligner que, en ce qui concerne les actions en annulation de la copropri\u00e9t\u00e9 des biens immobiliers, les conventions de comp\u00e9tence ne sont pas valables en raison de la nature imp\u00e9rative de l'article 12 du Code de proc\u00e9dure civile. En revanche, pour les biens meubles, de telles conventions de comp\u00e9tence peuvent \u00eatre \u00e9tablies. De plus, dans les cas de partage impliquant plusieurs biens meubles, le tribunal comp\u00e9tent est celui du lieu o\u00f9 se trouve l'un des biens immobiliers concern\u00e9s.<\/p><p>En cas d'action en partage impliquant \u00e0 la fois des biens meubles et immeubles, si ces biens se trouvent au m\u00eame endroit, la proc\u00e9dure se d\u00e9roulera dans ce lieu. Dans ce cadre, il suffit que la partie demanderesse soumette une requ\u00eate en justice et que la ou les parties d\u00e9fenderesses r\u00e9pondent \u00e0 cette requ\u00eate. Contrairement \u00e0 la proc\u00e9dure \u00e9crite, l'\u00e9change de m\u00e9moires se termine sans que les parties n'aient \u00e0 soumettre de m\u00e9moires suppl\u00e9mentaires (comme les r\u00e9pliques du demandeur et les r\u00e9pliques suppl\u00e9mentaires du d\u00e9fendeur). La partie d\u00e9fenderesse peut soulever des objections initiales et des questions concernant les conditions de l'action. Les objections initiales que le juge doit examiner d'office peuvent \u00e9galement figurer dans la r\u00e9ponse \u00e0 la requ\u00eate.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e7da5bf elementor-widget elementor-widget-spacer\" data-id=\"e7da5bf\" data-element_type=\"widget\" data-widget_type=\"spacer.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<div class=\"elementor-spacer\">\n\t\t\t<div class=\"elementor-spacer-inner\"><\/div>\n\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f1df17a elementor-widget elementor-widget-image\" data-id=\"f1df17a\" data-element_type=\"widget\" data-widget_type=\"image.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<img loading=\"lazy\" decoding=\"async\" width=\"300\" height=\"168\" src=\"https:\/\/kurcaloglu.com\/wp-content\/uploads\/2022\/10\/images-1.jpg\" class=\"attachment-large size-large wp-image-14362\" alt=\"\" \/>\t\t\t\t\t\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-2e8fb14 elementor-widget elementor-widget-heading\" data-id=\"2e8fb14\" data-element_type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Quelles sont les modalit\u00e9s de liquidation de la copropri\u00e9t\u00e9 ?<\/h3>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-a386bf3 elementor-widget elementor-widget-text-editor\" data-id=\"a386bf3\" data-element_type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t<p>Dans le cadre d'une action en liquidation de la copropri\u00e9t\u00e9, le partage des biens peut se faire soit par division en nature, soit par vente aux ench\u00e8res ou \u00e0 la n\u00e9gociation, avec partage du produit de la vente. Si aucun accord n'est atteint sur ces modalit\u00e9s de partage, le juge, \u00e0 la demande d'un des copropri\u00e9taires, ordonnera la division du bien en nature et, si les valeurs des parties divis\u00e9es ne sont pas \u00e9quivalentes, compensera la diff\u00e9rence de valeur en ajoutant une somme d'argent \u00e0 la partie inf\u00e9rieure.<\/p><p>D'autre part, si la division du bien soumis \u00e0 la copropri\u00e9t\u00e9 entra\u00eene une perte de valeur significative ou n'est pas jug\u00e9e appropri\u00e9e pour d'autres raisons, le bien sera vendu par ench\u00e8res publiques. Avec le consentement de tous les copropri\u00e9taires, il est possible que cette vente aux ench\u00e8res soit effectu\u00e9e uniquement entre les parties concern\u00e9es.<\/p><p>\u00a0Lors de la phase de vente, afin de guider la proc\u00e9dure d'ench\u00e8res, un expert d\u00e9sign\u00e9 par le tribunal effectuera une \u00e9valuation de la valeur du bien commun tant pendant le proc\u00e8s qu'imm\u00e9diatement avant les ench\u00e8res. La vente commence \u00e0 partir de 50 % du montant de la valeur d\u00e9termin\u00e9e par le rapport de l'expert, \u00e0 laquelle s'ajoutent les frais de vente et de partage, et ce montant peut augmenter en fonction des demandes des parties int\u00e9ress\u00e9es qui participent \u00e0 l'ench\u00e8re.<\/p><p>Dans les affaires de dissolution de la copropri\u00e9t\u00e9, si l'une des parties demande m\u00eame une division en nature, le juge doit d'abord \u00e9valuer cette demande et ne choisir la vente comme mode de partage que si une division en nature est impossible. L'argent obtenu de la vente des biens et\/ou droits sera r\u00e9parti parmi les copropri\u00e9taires en fonction des parts inscrites au registre foncier ou en parts \u00e9gales dans le cas de la copropri\u00e9t\u00e9 indivise.
