Si l'auteur est un fonctionnaire, il s'agit alors du crime de torture.<\/p>\n<p class=\" translation-block\">Victime : Tout le monde peut \u00eatre victime du crime de maltraitance. Il n'est pas n\u00e9cessaire qu'il y ait une relation particuli\u00e8re entre l'auteur et la victime.<\/p>\n<p class=\" translation-block\">Objet juridique : Ce sont les valeurs juridiques telles que l'int\u00e9grit\u00e9 physique, la sant\u00e9 mentale, l'honneur et la dignit\u00e9 de la personne.<\/p>\n<p class=\" translation-block\">Acte : Ce sont des comportements qui conduisent une personne \u00e0 souffrir. Il s'agit d'actes syst\u00e9matiques et continus qui portent atteinte \u00e0 la dignit\u00e9 humaine, provoquent de la douleur et de l'humiliation. Par exemple, laisser quelqu'un sans nourriture ni eau, le faire se promener nu, l'enfermer \u00e0 la maison, le forcer \u00e0 ing\u00e9rer des excr\u00e9ments, \u00e0 boire de l'urine, \u00e0 le battre \u00e0 intervalles r\u00e9guliers, \u00e0 l'humilier, \u00e0 le terroriser, ou \u00e0 l'exposer \u00e0 des animaux effrayants comme des chiens ou des serpents, ou r\u00e9pugnants comme des rats.<\/p>\n<p class=\" translation-block\">\u00c9l\u00e9ment moral : Il s'agit de l'intention. L'auteur doit vouloir infliger des souffrances \u00e0 la victime.<\/p>\n<h3><b>Quelle est la peine pour le d\u00e9lit de maltraitance ?<\/b><\/h3>\n<p class=\" translation-block\">La peine pour le d\u00e9lit de maltraitance est la suivante :<\/p>\n<p>La peine pour la forme de base du d\u00e9lit de maltraitance est de deux \u00e0 cinq ans d'emprisonnement (TCK 96\/1).<\/p>\n<p>La peine pour les formes aggrav\u00e9es du d\u00e9lit de maltraitance est la suivante : si le crime est commis contre une femme, la peine minimale ne peut \u00eatre inf\u00e9rieure \u00e0 deux ans et six mois (TCK 96\/2).<\/p>\n<p class=\" translation-block\">En cas de commission d'un crime d'eziyet dans des circonstances aggravantes, comme contre un enfant, une personne incapable de se d\u00e9fendre sur le plan physique ou mental, ou une femme enceinte, ainsi que contre des ascendants ou descendants, le p\u00e8re ou la m\u00e8re, le conjoint ou l'ex-conjoint, la peine peut aller de trois \u00e0 huit ans d'emprisonnement (article 96, alin\u00e9a 2 du TCK).<\/p>\n<p>\u0130\u015flenmesi halinde, ki\u015fi hakk\u0131nda \u00fc\u00e7 y\u0131ldan sekiz y\u0131la kadar hapis cezas\u0131na h\u00fckmolunur (TCK m.96\/2).<\/p>\n<h3><b>\"Quel est le d\u00e9lai de plainte et le d\u00e9lai de prescription pour le crime de torture ?\"<\/b><\/h3>\n<p>D\u00e9lai de plainte : Le crime de torture n'est pas un crime soumis \u00e0 plainte. \u00c9tant donn\u00e9 qu'il concerne l'honneur et l'int\u00e9grit\u00e9 physique et morale d'une personne, ce crime est enqu\u00eat\u00e9 d'office par les procureurs de la R\u00e9publique.<\/p>\n<p>Eziyet su\u00e7unun zamana\u015f\u0131m\u0131 s\u00fcresi: su\u00e7un temel veya nitelikli hali olmas\u0131na g\u00f6re de\u011fi\u015fir. Bu nedenle, fail ile ma\u011fdur aras\u0131nda bir uzla\u015fma sa\u011flanmas\u0131 halinde bile ceza kovu\u015fturmas\u0131 devam eder.<\/p>\n<h3>K\u00d6T\u00dc MUAMELE VE EZ\u0130YET SU\u00c7U ARASINDAK\u0130 FARK NED\u0130R?<\/h3>\n<p>Eziyet su\u00e7u ile k\u00f6t\u00fc muamele su\u00e7u aras\u0131ndaki fark, su\u00e7un faili, ma\u011fduru ve fiilinin niteli\u011fi bak\u0131m\u0131ndan ortaya \u00e7\u0131kar. K\u00f6t\u00fc muamele su\u00e7unda fiilin sistematik ve s\u00fcreklilik arz etmesi gerekmez.<\/p>\n<h3>EZ\u0130YET SU\u00c7U HANG\u0130 MAHKEMEDE G\u00d6R\u00dcL\u00dcR?<\/h3>\n<p>Eziyet su\u00e7una bakan mahkeme, asliye ceza mahkemesidir. Bu mahkeme, ceza yarg\u0131lamas\u0131nda ilk derece mahkemesi olarak g\u00f6rev yapar.
